New Spanish regulation to control pollutant emissions of combustion facilities
The new RD 1042/2017 has been passed and regulates the atmospheric emissions of the combustion plants with capacities between 1 to 50 MW, so called medium combustion plants. It transposes the Directive EU 2015/2193 on the limitation of emissions of certain pollutants into the air from medium combustion plants


The new regulation fills a legal space in terms of the emissions of the so-called medium combustion plants, that is to say those with combustion powers between 1 MW and 50 MW. Its practical application will be staggered for the existing installations. In this way, the existing facilities must comply with that established in the RD as of January 2025, in the case of the installations bigger than 5 MW and as of January of 2030 for the installations smaller than 5 MW.

In the case of new installations, the limits become 200 mg/Nm3 for SO2, 300 mg/Nm3 for NOx and 20 mg/Nm3 for particles. Instead, existing installations must meet laxer limits, limiting SO2 to 200 mg/Nm3, 650 mg/Nm3 for NOX and 30 mg/Nm3 (> 5MW) or 50 mg/Nm3 (<5MW) in the case of particles.
